A. Right of Withdrawal

Introduction

Consumers have a right of withdrawal under the following conditions. A consumer is any natural person who enters into a legal transaction for purposes that predominantly are not attributable to their commercial or self-employed professional activity.

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the last item.

You may use the attached sample withdrawal form, but it is not mandatory.

You may also exercise your right of withdrawal online on our website at https://lumeafragrances.com/en/pages/returnpolicy. If you use this online function, you will be sent a confirmation of receipt without delay on a durable medium (e.g. by email), containing information about the content of the withdrawal declaration as well as the date and time of its receipt.

To meet the withdrawal deadline, it is sufficient that you send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (except for the additional costs arising if you chose a type of delivery other than the least expensive standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees as a result of such reimbursement. We may withhold the reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earlier.

You must send back or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of the withdrawal from this contract. The deadline is met if you send back the goods before the period of fourteen days has expired.

You will bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Exclusion or Early Expiry of the Right of Withdrawal

The right of withdrawal expires prematurely in the case of contracts for the delivery of sealed goods which are not suitable for return due to health protection or hygiene reasons if their seal has been removed after delivery.

Linked/Financed Transactions

If you finance this contract through a loan and later revoke it, you are also no longer bound by the loan agreement, provided that both agreements form an economic unit. This is to be assumed, in particular, if we are your lender or if your lender uses our cooperation to finance the purchase. If the loan has already been disbursed to us at the time the withdrawal becomes effective or the goods are returned, your lender shall assume our rights and obligations under the financed agreement with respect to you. This does not apply if the present contract involves the acquisition of financial instruments (e.g., securities, foreign exchange, or derivatives). If you want to avoid a binding contractual commitment as far as possible, exercise your right of withdrawal and also revoke the loan agreement if you are entitled to do so.

General Notes

1) Please avoid damaging or contaminating the goods. If possible, return the goods in their original packaging with all accessories and packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, please use suitable packaging to ensure adequate protection against damage in transit.
2) Please do not return the goods freight collect.
3) Please note that the points above (1–2) are not a prerequisite for the effective exercise of the right of withdrawal.
